Terms and Conditions for DMME

1. General Provisions

These Terms and Conditions ("Terms") govern the use of the paid messaging service provided via dmme.ee, operated by Zero2One OÜ, a company registered in Estonia ("the Company"). By completing a payment to message Past Tense of Banana ("the Client"), the user ("Customer") enters into a binding agreement with the Company.

2. The Service

The Service facilitates a one-time digital communication between the Customer and the Client.

Fees: The fee for the Service is displayed at the point of purchase. Prices are inclusive of VAT where applicable.

Binding Agreement: By initiating payment, the Customer acknowledges that they are bound by these Terms.

3. Immediate Performance & Refund Policy

In accordance with the EU Consumer Rights Directive (2011/83/EU) regarding the supply of digital services:

No Right of Withdrawal: By completing the transaction, the Customer provides express consent for the Service to begin immediately (the transmission of the message). The Customer acknowledges and agrees that they forfeit their right of withdrawal and are not entitled to a refund once the message has been sent.

Automatic Reimbursement: Notwithstanding the above, if the Client (Past Tense of Banana) fails to provide a response to the Customer's message within 48 hours (or the specific timeframe specified on the message prompt), the fee will be automatically reimbursed to the original payment method.

4. Content and Conduct

The Customer is prohibited from sending messages that are defamatory, harassing, or in violation of Estonian or EU law. Zero2One OÜ reserves the right to refuse service or withhold reimbursement if a message violates these standards.

5. Limitation of Liability

Zero2One OÜ acts solely as a technical intermediary. The Company is not responsible for the specific quality, accuracy, or professional nature of the response provided by the Client. Total liability is limited to the amount of the individual transaction fee.

6. Governing Law

These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be settled in the Harju County Court (Harju Maakohus) in Tallinn.
